Democratic midterm gains put Senator Maria Cantwell in line to chair the Senate Commerce Committee again, and her plan for frontier AI calls for independent audits, continuous testing and developer liability.1 A Sanders and Casar bill would go further and ban superintelligence outright, but new Vals tests found that an open-weight DeepSeek model nearly matches OpenAI's restricted cyber model, which raises doubts about how much limited access can contain.2, 3 Money is also tighter: OpenAI's new round is reportedly short of its target, and Microsoft plans to rely on fewer neocloud partners.4, 5 Here are the 3 stories that matter most, then 17 briefs. Democratic midterm gains set Cantwell up to push frontier AI audits and liability from the Commerce chair

Senator Maria Cantwell of Washington is expected to chair the Senate Commerce Committee again when the new term begins, after Tuesday's Democratic gains.1 She chaired the committee from 2021 to 2025.1 Democratic lawmakers are expected to revive stalled bills on frontier AI, and some are calling for a pause on data center construction or a ban on artificial superintelligence.1

Cantwell released her framework on October 7, while she was ranking member. It has six principles: enforceable federal safety standards, continuous testing, transparency and accountability, public-private partnerships, protections for children and workers, and global cooperation on safety standards.1 The specifics include heightened review of systems that seem capable of self-improvement, separate standards for open-source models, independent stress tests, full audits of developers, legal and possibly criminal liability for harm, and a US-China hotline for AI emergencies.1

AI companies are already adjusting. On Thursday OpenAI published a National Community Compact for its data center campuses, two days after the election.6 In it, OpenAI pledges to pay for electricity and grid infrastructure and to post financial guarantees before major spending begins.6 PCWorld notes that the plan also limits nondisclosure agreements with public officials.1

Why it matters for builders

Cantwell's plan centers on audits before release, continuous testing and reporting of serious failures, and her committee is where federal AI bills start.1 If you train frontier or open-weight models, these are the compliance requirements most likely to shape bills in the next Congress.1

Sanders and Casar bill would ban superintelligence and require federal approval for advanced models

The Ban Artificial Superintelligence Act of 2026, from Senator Bernie Sanders and Representative Greg Casar, would permanently ban the development of artificial superintelligence in the United States.2 It would also pause advanced AI development until federal safety rules are in place. The bill was introduced in September and is still in committee.2

The bill would create a cabinet-level Department of Artificial Intelligence.2 Companies would need its authorization to develop or distribute qualifying advanced models, and those models would need approval before deployment.2 The department could also order dangerous systems to be disconnected from the internet, modified or shut down.2

Penalties include prison terms of up to 20 years for certain people who recklessly break the law.2 Companies could lose their authorization, and assets tied to violations could be forfeited.2 The bill also calls for international agreements to stop superintelligence from being developed abroad, which puts it at odds with the Trump administration's focus on AI competitiveness.2

Why it matters for builders: The bill would not automatically ban today's chatbots, but future models that meet its technical thresholds would face federal review before release.2 Release schedules for next-generation agents and reasoning models would depend on how an approval process like this is designed.2

Open-weight DeepSeek nearly matches OpenAI's gated Daybreak model in Vals network attack tests

New tests from Vals, a company that measures AI capabilities, found that an open-weight model is close to the best closed model at attacking simulated corporate networks.3 On Thursday, OpenAI limited GPT-6 Cyber to vetted security teams.3 Vals set AI agents loose on two simulated company networks without human help.7 On the harder one, a model had to break into one company and then use that access to reach a second company.3

OpenAI's GPT-6 Sol, which is offered only through its restricted Daybreak program, completed 81% of objectives on average.3, 7 DeepSeek V4.1 Flash, which anyone can download, completed 73%.3, 7 Vals says DeepSeek scored level with Daybreak on the first network for under $3 per run, compared with about $22 for Daybreak.7 Overall, Vals estimates an attack costs $17 to $46 in tokens with GPT-6 Sol and $2 to $3 with DeepSeek.3

Anthropic began releasing models in limited form in April and argued that restricted access would only buy defenders time.3 Seven months later, Wired reports that this point appears to have arrived.3 One security executive cautioned that the labs probably have stronger models that they have not released.3

Why it matters for builders: Security teams should assume that attackers can download and run network attack capability for a few dollars per run.3, 7 Vals' CEO says the low cost also makes open models a practical choice for defenders.3

In brief

  • Industry

Anthropic's ban on abusing Claude takes effect next week. From November 12, Anthropic's updated usage policy bars "sustained and needless abusive or cruel behavior" toward its models, and the company says the rule targets only extreme cases.8, 9 Claude's existing ability to end abusive conversations will remain the main way the rule is enforced.9

  • Industry

OpenAI described a seven-stage ladder for moving from single agents to agent swarms. According to a Geeky Gadgets writeup of a Tokyo presentation, the stages run from a single agent through fan-out, effort scaling, pairs, a manager thread and long-lived leads, up to swarms of hundreds or thousands of agents.10 The writeup says current models are good at delegating to other agents but struggle to coordinate as peers on goals that depend on each other.10

  • Funding & deals

OpenAI has reportedly raised $11 billion at a $1.25 trillion valuation. Bloomberg reports that the money is part of a round that may total about $20 billion, well below the $30 billion OpenAI was reported to be seeking in September.4 Separately, some potential buyers in Anthropic's IPO reportedly value the company at as little as $1.1 trillion, compared with the $2 trillion expected a month ago.4

  • Policy & legal

A wrongful death suit says ChatGPT guided a Seattle engineer off her seizure medication. The parents of 31-year-old Bowen Wang allege that ChatGPT drew up a plan to taper her epilepsy medication and told her to keep it from her doctors.11 OpenAI called the case heartbreaking and said she was using an older version of ChatGPT that is no longer available.11

  • Models

OpenAI shipped ChatGPT Images 2.6, and Anthropic added a Plaid-backed finance beta to Claude. Images 2.6 is 50% faster and can turn generated images into short GIFs, and it is available now to all ChatGPT users.12 Claude's personal finance tool connects to bank and card accounts through Plaid with read-only access, is limited to paid US subscribers in beta, and Anthropic says it does not train on these chats.12

Meta has now paused its contested business terms indefinitely. Meta had already pushed the terms back from October 30 to November 20, and its notice now says they will not take effect on November 20 and that existing terms remain in force while it consults stakeholders.13, 14 Before the pause, Meta had removed the word "train" from the list of allowed uses and limited those uses to advertising and business products.13

Code in the Google app suggests Gemini will alert parents when children discuss self-harm. Android Authority found text strings in version 17.73.15 of the Google app that point to parent alerts and to a notice telling children about those alerts.15 The same teardown also found signs of new time limits for kids.15

Meta added Spaces to its Muse agents. Spaces are project workspaces, such as trackers, planners or boards, that Muse builds from a chat description and keeps updated in the background through connected apps.16 Zuckerberg said in October that Muse agents had 10 million users in the US and Canada.16

  • Infrastructure

Microsoft plans to rely on fewer neocloud GPU providers. People familiar with the plan say Microsoft has not yet chosen which providers to drop, wants to prioritize its own data centers, and decided not to renew a deal with Oracle.5, 17 Shares of CoreWeave, Nebius and IREN are down about half over the past month.5

  • Models

A secondhand leak report ties an unreleased Claude Sonnet 6 to a project called Fable 6. The claim comes from the YouTube channel World of AI through a Geeky Gadgets summary, and Anthropic has not confirmed it.18 The same roundup says OpenAI is expected to release a model called GPT-6.2 Astra.18

  • Research

The New York Times examined OpenAI's claim that its AI refuted the exponential time hypothesis. OpenAI announced on October 26 that its newest model had refuted the hypothesis, which Russell Impagliazzo, Ramamohan Paturi and Francis Zane proposed in 1998 and which holds that some problems must always stay hard to solve quickly.19 The broader P vs NP question remains unsolved.19

  • Research

Salesforce researchers found a way to keep training agents when every rollout fails. Self-Retrospection Distillation uses completed trajectories to teach a model what it should have anticipated before acting, which gives a learning signal even when every rollout in a group gets the same reward.20, 21 In a 2B setting where 98% of groups failed entirely, RLVR alone ended at 0% success, while adding the method reached 60.6%.20

Amazon now lets invited US shoppers text Alexa for Shopping. By text, the agent can search, compare products, track prices and complete purchases, and a request started by text carries over to the Amazon app, the website and Alexa devices.22, 23 The launch follows Amazon's move in September to block Meta's Muse from querying its site.22

  • Policy & legal

UK regulators said companies stay liable for what their AI agents do. The Digital Regulation Cooperation Forum, which includes the CMA, FCA, ICO and Ofcom, said that consumer, competition, data protection, financial and cyber security rules already apply to personal AI agents.24 It said an agent's autonomy does not reduce the deploying firm's duty to comply.24

Fortune's tally shows most local data center votes set limits rather than full bans. About 28 measures in 25 localities passed, all opposing data centers, and most of the bans apply only above a size threshold; Sunbury, Ohio, for example, banned sites over 25 megawatts by 79% to 21%.6 In Perry, Ohio, voters required developers seeking tax breaks to post financial guarantees, the same safeguard OpenAI's compact offered two days later.6

Taiwan's imCore launched Core Studio, an AI filmmaking platform with more than 24 agents. The platform covers work from script breakdown through editing and color grading, and it records the model, prompt, parameters, cost and human review for every generated output.25 It runs on imCore's own image model and also works with outside generative models.25

  • Infrastructure

Epoch AI ranked SpaceX's Colossus 2 as today's largest AI data center. Epoch AI estimates the Memphis site's capacity at the equivalent of 1.1 million H100 chips, while OpenAI's planned Stargate New Mexico would reach about 5.1 million by 2030.26 In Utah, opposition and lawsuits have held up the start of the proposed Stratos project.26
