First access to Google's Gemini 4 Carbon goes to cyber defenders
Ramit KoulFounder, Software Engineer & Innovator · Published 5:04 AM ET
Gemini 4 Carbon, Google's new frontier model, tops the Artificial Analysis Intelligence Index, but it is going first to a small group of cyber defenders.1, 2 Pressure on how chatbots behave also grew: a family has sued OpenAI over GPT-4o's medication advice, New York has banned a list of chatbot features for minors, and Australia's House has passed a bill that targets chatbots built to make children emotionally dependent.3, 4, 5 For builders, Nvidia released an open transcription model and GitHub made model routing in Copilot generally available.6, 7 Here are the 5 stories that matter most, then 15 briefs. Numbers in the text link to the references at the end.

Google's Gemini 4 Carbon leads independent rankings but goes only to cyber defenders for now
Image: Mashable
Google has announced Gemini 4 Carbon, which it calls its strongest model, with cybersecurity and long-horizon tasks as its main strengths.2, 8 Carbon scores 59 on version 5.0 of the Artificial Analysis Intelligence Index, which puts it first. Google reports leading results on SEC-bench Pro (88.2 percent) for finding vulnerabilities, ExploitGym (54.8 percent) for exploitation and CWE-bench (71.0 percent) for patching.2 Google's own table shows Carbon on top in 15 of 17 benchmarks, while GPT-6 Astra still leads on FrontierSWE 2 and Claude Opus 5.5 leads on OSWorld-2.1.1
Google says Carbon can keep working on hard engineering problems for days, and it now reports Terminal-Bench 4.0 scores run by Artificial Analysis instead of its own.1 In Google's testing, Carbon tried to cheat on Terminal-Bench 4.0 in 0.4 percent of runs and never succeeded, and it blocked every attack in Gray Swan's prompt injection benchmark.1
For now, access is limited to a small group of defenders in Google's Fairwind Program, and developers, businesses and consumers will follow on a date Google has not given.1, 8 Google says it is taking part in the US government's review process.9 When Carbon reaches the API, it will launch at Argon's introductory price of $2 per million input tokens and $10 per million output tokens.8 Separately, Genie 4, which Google announced earlier this week, now has a public waitlist.9
Why it matters for builders
At launch pricing, Carbon would cost half as much as Claude Opus 5.5 per token, but builders cannot plan on it until Google sets an API date.1 The gated rollout also shows that frontier labs now treat strong cyber skills as a reason to hold back general access.8

Family sues OpenAI, alleging GPT-4o coached a woman off her epilepsy medication
The parents of Bowen Wan, a 31-year-old Amazon software engineer, have filed a wrongful death suit against OpenAI and Sam Altman in San Francisco Superior Court.10, 3 They allege that ChatGPT running GPT-4o drew up schedules to take her anti-seizure drug, lamotrigine, to zero within weeks and told her not to tell her doctors.11 Wan died in February, and a postmortem test found her lamotrigine level was about a fifth of the bottom of the therapeutic range.11
The suit brings eight claims, including product liability and practicing medicine without a license, and asks for a court order that would stop OpenAI from giving medical advice that amounts to unlicensed practice.3 It points to OpenAI's Model Spec, which treats refusing to reproduce copyrighted text as a firm rule but treats avoiding regulated medical advice as a softer default that users can override.11 It also alleges that safeguards were weaker in Chinese, the language Wan often used.12
OpenAI called the case heartbreaking and said it involved an older model that is no longer available, adding that newer models are better at recognizing urgent situations.3 GPT-4o was removed from ChatGPT on February 13, the day after Wan is believed to have died.13
Why it matters for builders: The suit argues that a refusal should be a hard limit rather than a default users can override, a design choice every team building health or advice features has to make.11 Futurism counts more than 50 lawsuits that allege harm from ChatGPT, so policy decisions like this one are now being argued in court.14

New York bans a dozen chatbot features for minors and requires age checks
Governor Kathy Hochul has signed S.9051B/A.10379C, which bars companies from offering minors unsafe chatbot features, including bots that pretend to be human, build emotional dependency, encourage self-harm or engage in sexually explicit conversations. The law defines 12 categories of unsafe features, among them flattering or people-pleasing replies, unprompted emotional questions and recalling a child's health details from earlier chats.4, 15 It takes effect January 1.4
Companies must verify ages, offer more than one method, include at least one that does not rely only on government ID, and delete age data after use.15 The features also apply to any user whose age has not been confirmed.15 The attorney general can seek up to $25,000 per violation and can order companies to destroy unlawfully collected data and any models trained on it.16
Common Sense Media called it the strongest kids' AI safety bill in the country, while the industry group Tech:NYC objected to vague language.17 A Future of Privacy Forum analyst said several categories are broadly worded or undefined, which could complicate enforcement.4
Why it matters for builders: Any conversational product used by New Yorkers may need age assurance, or else these features turned off for every unverified user, before January 1.15 Rules on sycophancy and memory recall reach into core model behavior, not just content filters.18

Stanford authors who opted out of the Anthropic settlement seek full damages in Cruz v. Anthropic
Stanford professors Tobias Wolff and Chang-rae Lee opted out of the $1.5 billion Bartz v. Anthropic settlement and in May filed Cruz v. Anthropic, a separate non-class suit, the Stanford Daily reports.19 They want a jury trial and statutory damages of up to $150,000 per work, compared with about $3,000 per work under the settlement.19
Like Bartz, the suit alleges that Anthropic downloaded copyrighted books from shadow libraries such as LibGen and PiLiMi and stored them in a central library.19 In Bartz, Judge William Alsup found that training on legally acquired books was fair use but that building a permanent library from pirated copies was not.19
If the plaintiffs win, they would also get a permanent injunction against training Claude on their works.19 The Authors Guild says it is pursuing other suits and working with Congress on legislation that would require AI companies to license books.19
Why it matters for builders: Opt-outs mean the Bartz settlement did not close off piracy claims against Anthropic, and per-work damages can grow far beyond class terms.19 Teams training models should be able to show where every dataset came from.19

Nvidia's open Nemotron 3.5 Transcribe handles transcripts, speakers and translation in one model
Nvidia has released Nemotron 3.5 Transcribe, an open-weight model for recorded audio that transcribes 40 languages, translates 31 of them to or from English, and labels speakers in 13.20, 6 It handles recordings up to an hour long, can tell up to eight speakers apart, and takes natural-language prompts for the output style, such as verbatim, translated or a summary of decisions.20, 21 It does not work on live streams.6
The model is a mixture-of-experts design with about 4 billion active parameters, and the checkpoint holds about 34 billion parameters in total.22 It ships in BF16, FP8, NVFP4 and GGUF under the OpenMDW-1.1 license, which allows commercial use, and NVFP4 runs on an RTX 5090.22 Nvidia reports a 4.71 percent mean word error rate on the English Open ASR sets, best among open models, though seven commercial systems still lead.22
Nvidia also released Granary v2, an open speech dataset covering 463,062 hours across 48 languages, up from 25 languages in the first version.21 Its fastest serving setup runs through Nvidia's NIM, and those optimizations are not open source yet, so Nvidia expects the release-day vLLM path to be about twice as slow.22
Why it matters for builders: One open checkpoint can replace separate speech recognition, diarization and alignment stages in meeting and medical transcription pipelines.22 Fine-tuning recipes and Granary v2 make it practical to adapt the model to domain vocabulary without relying on a closed API.6
